KEY POINT
As per ARTICLE 76 of the Indian Constitution, the ATTORNEY GENERAL OF INDIA IS THE HIGHEST LAW OFFICER in the country.
ROLE OF ATTORNEY GENERAL OF INDIA :
1. He is the CHIEF LEGAL ADVISOR TO THE GOVERNMENT OF INDIA and advises it on all legal matters.
2. As the Primary Lawyer, he represents the Union Government in the Supreme Court of India.
3. He also ADVISES THE PRESIDENT OF INDIA on the legal matters referred to him
.
IMPORTANT POINTS :
1. The Attorney General of India has the RIGHT TO SPEAK AND TAKE PART IN THE PROCEEDINGS OF BOTH THE HOUSES OF PARLIAMENT, i.e. Lok Sabha and Rajya Sabha.
2. The Attorney General of India CAN BE A MEMBER OF ANY COMMITTEE OF THE PARLIAMENT.
3. The Attorney General of India possesses No Voting Rights when he takes part in proceedings of the Parliament.
4. The Attorney General of India is NOT CONSIDERED AS A GOVERNMENT SERVANT, rather is a part of the Union Executive.
5.The Attorney General of India CANNOT ADVISE OR HOLD A BRIEF AGAINST THE UNION GOVERNMENT, also cannot defend an accused without the permission of the Union Government.
